Partner listing terms
The terms brands agree to when they list products on Evra. Read them alongside How we choose, which explains the checks we make.
Draft, to be reviewed by a solicitor before launch. Text in square brackets is a placeholder for details Evra has not confirmed yet.
Last updated:
The short version
- Before we list a product, we check it against the criteria in How we choose. Listing is our decision.
- You give us complete, accurate information about each product, with evidence for every claim, and you keep it up to date.
- Your products must meet the law that applies to them, such as product safety law and the rules for cosmetics, cleaning products and food. Our checks do not take that responsibility from you.
- We write the product page. We can edit or refuse any wording, and we can pause or remove a listing at once if there is a safety, legal or accuracy concern.
- [PLACEHOLDER: confirm that paying commission or a fee never buys a listing, the Checked badge or what we say about a product].
- You let us use your product images and text to list and promote your products, and you promise you have the right to let us.
About these terms
These terms apply between [PLACEHOLDER: legal name of the business], trading as Evra ("Evra", "we", "us"), and the business that lists products with us ("you"). They cover every product you ask us to list on myevra.com.
They are business terms. By listing with us, you confirm that you are acting for a business, not as a consumer.
[PLACEHOLDER: how a brand accepts these terms, for example by signing a partner agreement or confirming by email before its first listing]. If you have a signed partner agreement with us and it conflicts with these terms, the partner agreement wins.
Read these terms with:
- How we choose, which sets out the checks we make and the documents we ask for;
- Affiliate and commercial relationships, which explains to shoppers how we make money and how we order products;
- our privacy policy, which explains how we handle personal data, including that of your staff who contact us.
How your products can appear on Evra
There are two ways. We agree with you which one applies to each product.
Buy from brand
We list the product and link to it on your own website. The shopper buys from you, under your terms of sale, delivery and returns. You are the seller, and you handle the order, delivery, returns, refunds and complaints about the order. We may earn a commission on the sale.
Sold by Evra
When our checkout opens, we may buy stock from you and sell it to shoppers ourselves. We are then the seller, and we deal with the shopper. [PLACEHOLDER: supply terms for products Evra buys to sell, for example ordering, delivery to Evra, prices and payment, faulty stock and returns to the brand].
Evra is not an online marketplace: brands do not sell to shoppers through our checkout in their own name. If that changes, we will update these terms before it happens.
Who can list, and our checks
To list with us:
- your products must be everyday essentials in our categories: kitchen, cleaning, body care, pantry, home and baby;
- they must be legal to sell in Great Britain [PLACEHOLDER: and in Northern Ireland, if Evra delivers there];
- you must be a business that is legally responsible for the products, or that has the right to supply them;
- [PLACEHOLDER: any other conditions, for example a UK business address or a minimum trading history].
Before we list a product, we check it against the criteria in How we choose. In short, we read the full ingredient or materials list, check each claim against your evidence, ask for the safety and compliance documents for that type of product, and check the packaging and recycling information. We may ask you questions or for more evidence at any stage.
Whether we list a product is our decision. Meeting the criteria does not oblige us to list it. If we decide not to, we will tell you, and where we can, we will tell you why.
Our checks are our own review, made for our shoppers. They are not a laboratory test, a certification or an approval of your product's safety or legality, and they do not move any of your legal responsibilities to us. Please do not describe the Checked badge, or a listing on Evra, as any of those things. [PLACEHOLDER: what brands may say about Evra and the Checked badge in their own marketing, for example "Available at Evra"].
Information and evidence you must give us
For each product, before we list it, you give us:
- the full ingredient list (using INCI names for cosmetics), or for kitchen and home items the full list of materials, including parts such as lids, seals, coatings and inks that touch food;
- the size or quantity, directions for use, warnings, precautions and allergen information, exactly as they appear on the label;
- evidence for every claim on the label, packaging or your website that you would like us to repeat (see How we review claims and wording);
- the safety and compliance documents that apply to that type of product (see Rules for each type of product);
- what the packaging is made of, and how to recycle it;
- the name and postal and email address of the manufacturer and, for imported products, the importer, and of the business responsible for the product in the UK;
- for Buy from brand products, the web address of the product on your website and its current price;
- product images you own or have permission to use. [PLACEHOLDER: image requirements, for example size and background].
Everything you give us must be accurate, complete and not misleading, and must describe the product as it is actually sold. Keep copies of your evidence and documents, and send them to us again on request.
Rules for each type of product
You are responsible for making sure each product meets the law that applies to it. These are the main points we ask about. The list is a guide, not a full statement of the law.
All products
- Product safety law, including the General Product Safety Regulations 2005 in Great Britain, and any rules for that particular kind of product.
- Labelling in English, and traceability information: the manufacturer's details and, for imports, the importer's.
- If we deliver to Northern Ireland, the information EU product safety law requires there, including a responsible business in the EU or Northern Ireland. [PLACEHOLDER: whether Evra delivers to Northern Ireland].
Body care and baby toiletries (cosmetics)
- A named UK Responsible Person, established in the UK, and the product's safety assessment (the cosmetic product safety report).
- Notification of the product on the UK Submit Cosmetic Product Notification service (SCPN) before it is first sold in Great Britain.
- A label that meets UK cosmetics law, including the Responsible Person's name and address, the amount, the date of minimum durability or period after opening, precautions, the batch number, the function where it is not obvious, and the ingredients.
- Claims that meet the common criteria for cosmetic claims, and no claims that the product treats or prevents any disease or condition.
- You, or the Responsible Person you appoint, stay the Responsible Person for your products. Listing or selling them under your brand does not make Evra their Responsible Person. [PLACEHOLDER: solicitor to confirm].
Cleaning and laundry products
- Labelling under GB CLP for hazardous mixtures: pictograms, signal word, and hazard and precautionary statements, with child-resistant fastenings and tactile warnings where the rules require them.
- The hazard information from the label, so that we can show it on the product page. A web page that lets the public buy a hazardous product must state its hazards.
- A safety data sheet, where one is required.
- Labelling under the Detergents Regulation, and the web address of the product's ingredient data sheet.
Pantry (food)
- Registration as a food business with your local authority.
- All the mandatory food information: the name of the food, ingredients with allergens emphasised, quantity, nutrition declaration, storage conditions and directions, the name and UK address of the business responsible, and origin where required. We must be able to show this before purchase, as the law requires for food sold online.
- Nutrition and health claims only from the GB register, used under their conditions of use.
- Certification details for any product called organic.
Kitchen items that touch food
- Compliance with food contact materials law, and a declaration of compliance where the rules require one.
- The words "for food contact", a statement of use or the glass and fork symbol, unless the use is obvious, and any restrictions on use, such as temperature limits.
Home textiles
- The fibre composition, using the approved fibre names, so that we can show it before purchase.
- For filled or upholstered items, compliance with the furniture and furnishings fire safety rules.
Other baby items
- The safety standards each product meets, and any rules for that kind of product (for example toy safety, if an item is a toy).
- Age ranges, warnings and instructions, so that we can show them on the product page.
[PLACEHOLDER: Andi to confirm these lists, ideally with a regulatory adviser, and keep them in step with the documents list in How we choose.]
How we review claims and wording
We are responsible for what we publish, even when the words came from you. So:
- we only repeat a claim when you have given us evidence that supports it for the product on sale, as shoppers will understand it;
- we write each product page ourselves, in our own words and style, and we decide the final wording and what it includes;
- we can edit, shorten, qualify or leave out any claim or wording, and refuse to publish anything we cannot support;
- we may ask for more evidence at any time, including after a product is listed.
In particular, we do not publish:
- health or medical claims, or claims that a product treats, prevents or cures any condition, such as eczema;
- "clean", "natural", "eco", "green", "sustainable", "chemical-free", "safe" or similar words as claims on their own. We only use words like these when the claim is specific, explained on the page and backed by evidence we have seen;
- "free from" claims for ingredients the law already bans in that kind of product, or that suggest a lawful ingredient is harmful;
- environmental claims that do not meet the CMA's Green Claims Code and the advertising rules. Retailers can be responsible for green claims they repeat, so we look for evidence that covers the whole life of the product, or a claim that clearly says what it covers;
- nutrition or health claims for food that are not on the GB register;
- reviews, ratings or testimonials. Please do not send them to us to publish.
If you think something on one of your product pages is wrong, tell us and we will correct factual errors as quickly as we can.
Keeping information accurate
You must tell us in writing:
- before a change: at least [PLACEHOLDER: notice period, for example 30 days] before you change a product's formula, ingredients, materials, label, packaging, size or claims, so we can check the change before the listing is updated. We may pause the listing until we have;
- straight away, and within [PLACEHOLDER: hours, for example 24 hours]: if a product is recalled or withdrawn, if you become aware of a safety problem or a serious reaction, if a regulator contacts you about a listed product, or if anything you have told us stops being true;
- for Buy from brand products: when the price, availability or web address changes. [PLACEHOLDER: how brand prices and stock are kept up to date, for example a product feed or by email].
We check listed products again [PLACEHOLDER: how often products are re-checked, for example every 12 months], and you agree to send updated information and evidence when we ask.
Concerns, suspension and removal
When someone raises a concern
Shoppers, regulators and others can report a concern about a listed product, for example through our contact page. We also watch official recall and safety alert lists, including the Office for Product Safety and Standards' product safety database, product recalls on GOV.UK and the Food Standards Agency's food alerts. When a concern reaches us:
- We record it and assess it. We look at what was reported and the information we hold.
- We act on safety first. If there may be a risk to health or safety, or the concern comes from a regulator, we pause the listing straight away while we look into it. [PLACEHOLDER: target time to pause a listing after a credible safety report].
- We ask you. We tell you about the concern (without sharing the reporter's personal data unless they agree or the law allows) and ask for your response and any evidence within [PLACEHOLDER: number of days].
- We decide. We restore, correct or remove the listing, and tell you what we have decided and why.
You agree to cooperate with us, and with any regulator, on concerns, recalls and corrective action about your products. We may share information about your products with regulators, Trading Standards and other authorities when they ask or when we have a legal duty to.
Pausing or removing a listing
We may pause or remove a listing at once, without notice, if:
- there is a safety concern, recall or official alert about the product;
- a regulator or other authority asks us to, or the law requires it;
- information or evidence is missing, out of date, inaccurate or misleading;
- the product no longer meets our criteria;
- you seriously break these terms;
- we reasonably believe that keeping the listing could harm shoppers or Evra's reputation.
We may also remove a listing for any other reason by giving you [PLACEHOLDER: notice period, for example 14 days] notice. Where we can, we will tell you why we have paused or removed a listing, unless the law or an authority prevents us. You can reply with more information, and we will look at the decision again. A listing goes back up only once the issue is fixed and the product has been checked again.
Your images, text and brand
You keep ownership of your brand names, logos, product images, text and other materials. You give us a non-exclusive, royalty-free licence to use, copy, display and adapt them (for example by cropping, resizing or editing them for length, accuracy and our style) to list and promote your products:
- on myevra.com;
- in our emails to subscribers;
- [PLACEHOLDER: other channels, for example Evra's social media accounts and advertising].
The licence lasts while your products are listed, and for a reasonable time afterwards so we can remove them. We do not have to remove materials from emails already sent or posts already published.
You promise that you own these materials or have permission to let us use them in this way (including permission from photographers and anyone shown in images), and that our use of them will not infringe anyone else's rights.
You may say that your products are available on Evra. Please ask us before using the Evra name or logo in any other way, and do not suggest that Evra endorses your business beyond listing your products.
Your promises to us
You promise that:
- you are entitled to agree to these terms and to supply the products;
- everything you give us is accurate, complete and not misleading, and your evidence is genuine and supports the claims it is given for;
- your products, their labels and their packaging meet all the laws that apply to them in the UK, including product safety, cosmetics, chemicals, detergents, food, food contact and textile labelling laws;
- you will tell us straight away if any of these promises stops being true;
- you have product liability insurance of at least [PLACEHOLDER: minimum cover] for each claim, and will show us proof on request;
- you will not offer anyone at Evra any payment, gift or other benefit to influence our checks, a listing or what we say about a product.
Indemnity
You will compensate us for losses, costs (including reasonable legal costs), claims and, where the law allows, penalties that we suffer because:
- information, evidence or claims you gave us were inaccurate or misleading;
- a product was unsafe, defective or did not meet the law;
- your materials infringed someone else's rights;
- a product was recalled or withdrawn, including the reasonable costs of dealing with that for products we sold;
- you broke the promises above.
We will tell you promptly about any claim, take reasonable steps to limit our losses, and not settle a claim covered by this indemnity without talking to you first. [PLACEHOLDER: solicitor to confirm the scope of the indemnity and how it relates to the limits on liability].
Fees and commission
- Commission on Buy from brand sales: [PLACEHOLDER: commission rates, and whether sales are tracked through an affiliate network (name it) or directly with Evra].
- Listing or partner fees: [PLACEHOLDER: any listing, partner or other fees, what they are for and when they are charged, or confirm that there are none].
- Products sold by Evra: [PLACEHOLDER: wholesale prices, invoicing and payment terms for stock Evra buys].
- Invoices and VAT: [PLACEHOLDER: how and when invoices are raised and paid, and how VAT is handled].
[PLACEHOLDER: confirm that no payment buys a place on Evra: paying commission or any fee does not buy a listing, the Checked badge, a review or what we say about a product, and every product goes through the same checks]. [PLACEHOLDER: confirm that no position in our listings is paid for. If paid placements are ever offered, each one must be labelled as sponsored next to the product, and this section updated].
Data protection
Each of us is a separate controller of the personal data it handles, and each of us will meet UK data protection law (the UK GDPR and the Data Protection Act 2018, as amended by the Data (Use and Access) Act 2025).
- Buy from brand: when a shopper follows a link to your website, you are responsible for the personal data you collect there, and for any cookies or tracking on your website. We do not pass you shoppers' names or contact details. [PLACEHOLDER: what, if anything, an affiliate link or network passes to the brand, for example a click reference].
- Sold by Evra: we do not share our customers' personal data with you unless it is needed, for example for a recall or to deal with a fault, and then only under [PLACEHOLDER: data sharing terms].
- Contact details: we each use the business contact details of the other's staff only to manage our relationship. Our privacy policy explains how we handle them.
- Neither of us will use the other's customers' personal data for marketing, or for any purpose not agreed, without a lawful basis.
- We will each tell the other without undue delay about a personal data breach affecting data we share, and help each other with rights requests and complaints about it.
Limits on liability
Nothing in these terms limits or excludes either party's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow to be limited.
Subject to that:
- neither of us is liable to the other for loss of profit, loss of business, loss of goodwill or any indirect or consequential loss;
- our total liability to you under these terms is limited to [PLACEHOLDER: liability cap, for example the commission and fees Evra received from you in the 12 months before the claim];
- we do not promise any level of sales, visits or clicks, or that the website will always be available or free from errors.
[PLACEHOLDER: solicitor to confirm whether the indemnity is outside the cap, and the wording of this section].
How long these terms last and how they end
These terms start when you accept them, and continue until either of us ends them.
- Either of us can end them by giving [PLACEHOLDER: notice period, for example 30 days] notice in writing.
- We can end them at once by telling you in writing if you seriously break them (for example by giving us false evidence or failing to tell us about a recall), if a regulator requires it, or if your business becomes insolvent.
When they end:
- we remove your listings within [PLACEHOLDER: number of days];
- commission and fees already earned remain payable under the terms above;
- [PLACEHOLDER: what happens to stock Evra holds, for example Evra may sell it or return it];
- the sections on concerns and recalls, your promises, the indemnity, data protection, limits on liability, confidentiality and governing law keep applying where they need to.
Changes and general terms
Changes. We may change these terms by giving you at least [PLACEHOLDER: notice period] notice by email. If you do not agree to a change, you can end these terms before it takes effect. A change needed urgently for legal or safety reasons can take effect sooner, and we will tell you why.
Confidentiality. We will each keep confidential the other's non-public business information, such as commission rates, unpublished products and evidence you mark as confidential. Either of us may share it where the law or a regulator requires, or with our professional advisers. Information we publish on product pages is not confidential.
Our relationship. These terms do not create a partnership, joint venture or agency between us. Neither of us can act for the other.
Transfer. You may not transfer your rights under these terms without our written agreement. We may transfer ours to a business that takes over Evra.
Notices. Notices under these terms are made by email: to us at [PLACEHOLDER: partner contact email], and to you at the address you gave us.
Other points. Only you and we have rights under these terms. If a court decides that part of them cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. These terms, with any signed partner agreement, are the whole agreement between us about listing on Evra.
Governing law
These terms, and any dispute about them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. [PLACEHOLDER: confirm the governing law and courts with a solicitor].
Questions about these terms
Email [PLACEHOLDER: partner contact email], or send an enquiry through our page for brands that want to list with Evra.
